Welcome to MySanta. These Terms and Conditions ("Terms") govern your use of our website and the purchase of our personalised Santa video services. By accessing our site or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
These Terms are an agreement between you ("the Customer", "You") and MySanta ("We", "Us", "Our").
2. Service Description
MySanta provides personalised digital video messages from Santa Claus tailored for children. Our current service offerings include:
Standard personalised videos for one, two, or three children.
An "Extra-Personalised" video option for one child (including specific interests/hobbies).
Please note that we do not currently offer videos for groups larger than three children.
3. Eligibility and User Responsibilities
To use our service, you confirm that:
You are at least 18 years of age.
You are the parent or legal guardian of the child or children pictured and named in the order.
All information provided (names, ages, interests) is accurate and spelled correctly.
The photographs provided are decent, lawful, and do not infringe on any third-party rights.
4. Ordering Process
1. Submission: You will complete an online form providing the child’s details and uploading a photograph.
2. Acceptance: Your order is accepted when payment is successfully processed, at which point a contract comes into existence between you and us.
3. Errors: Please double-check all spellings and ages before submitting. As these videos are automated based on your input, we are not responsible for errors made by you during the input process (e.g., misspelled names), though we will attempt to assist if you contact us immediately.
5. Payment Terms
Accepted Payment Methods:
Credit/Debit Cards: We accept major bank cards via our secure payment processor.
Digital Wallets: Apple Pay and Google Pay.
Payment is due in full at the time of ordering. We utilise secure third-party payment processors to handle transactions. We do not store your full credit card details.
6. Delivery Policy
Our videos are digital products delivered via the internet. We do not ship physical products.
Delivery Timelines:
Orders placed before 5:00 PM: Will be processed and sent out by the end of the same day.
Orders placed after 5:00 PM: Will be processed and sent the following day.
Method of Delivery:
Email: You will receive an email containing a direct link to your video when it is ready.
My Order Page: You can access and download your video via the "My Order" page on our website using your order number and email address.
Download Period:
We retain your video file until January 31st of the current Christmas season. You must download your video before this date. After January 31st, the file will be permanently deleted from our servers.
7. Refund Policy (100% Satisfaction Guarantee)
Per EU Consumer Law, the right of withdrawal (cooling-off period) usually does not apply to goods made to the consumer's specifications or clearly personalised.
However, at MySanta, we offer a voluntary Satisfaction Guarantee:
If you are not happy with the video you receive for any reason, please contact us. We will issue a 100% refund of your purchase price.
Refund requests must be made within 14 days of receiving the video.
Refunds will be processed to the original method of payment.
8. Intellectual Property and Content Usage
Your Content:
You retain ownership of the photos and personal details you submit. By submitting them, you grant MySanta a temporary, non-exclusive license to use, modify, and process these materials solely for the purpose of creating your order.
Our Content:
The underlying video footage, script, Santa character performance, logo, and website design are the intellectual property of MySanta. You may not copy, distribute, or sell the video files for commercial purposes. You are free to share the video with friends and family and on personal social media channels.
9. Data Protection and Privacy
We are committed to protecting your privacy in accordance with the General Data Protection Regulation (GDPR). For full details on how we handle your data, please refer to our Privacy Policy.
10. Limitation of Liability
MySanta shall not be liable for any indirect, incidental, or consequential damages arising out of the use of the service.
Our total liability to you for any claim arising out of the service shall be limited to the amount you paid for the service.
We are not liable for delivery delays caused by technical failures beyond our control (Force Majeure), provided we endeavour to resolve them as quickly as possible.
